The Enlightenment was a pivotal period in the development of modern principles of justice, rights, and ethical governance, and the philosophical frameworks created in its wake continue to influence our understanding of a just society. These frameworks underscore the importance of equality, fairness, and the dignity of individuals—ideals that AI must support rather than undermine. This understanding is important as the AI Techno-giants have started confronting the governments on the question of regulations. 

The Inescapable Role of AI in Society

AI is not just a tool but an integrated aspect of modern life, influencing areas as diverse as healthcare, education, employment,  social media and other cognitive tasks. This wide-reaching influence means that AI’s impacts on justice are far-reaching and multifaceted, affecting access to resources, employment opportunities, and personal rights. AI systems, however, are primarily driven by data that reflects historical and often biased patterns, leading to outcomes that can be at odds with principles of justice.

Justice as the Ultimate Human Goal

Justice is not only the foundation of societal stability but also a measure of our collective ethical progress. Historically, justice has served as the ultimate goal of any social contract, from the ideas of fairness in John Rawls’ “veil of ignorance” to Amartya Sen’s emphasis on capability and freedom. Sen’s framework is rooted in the idea that individuals should have the freedom and capability to pursue valuable life outcomes, which requires decision-making processes grounded in fairness, objectivity, and sensitivity to human diversity. However, while AI can be instrumental in expanding certain capabilities, it falls short of achieving Sen's standard of objective rationality due to inherent limitations in overcoming bias, context sensitivity, and ethical reasoning.

   In Sen’s framework, objective rationality demands impartiality and freedom from biases that could limit fair and equitable choices. Such biases compromise the objectivity needed for fair capability enhancement.

2. Inadequate Sensitivity to Human Diversity and Context

   Sen’s capability approach emphasizes the importance of individual diversity, where people have different needs, values, and aspirations. AI, however, often applies generalized models that may overlook personal or cultural nuances, failing to adapt to individual contexts. This insensitivity can lead to a one-size-fits-all approach in areas like education, healthcare, or welfare distribution, where AI recommendations might neglect the unique circumstances or challenges faced by marginalized groups. Such limitations prevent AI from supporting the personalized empowerment Sen envisions, making it unable to fully promote equitable capability development across diverse populations.

   Sen's approach requires decision-making processes that consider not only efficiency but also ethical values and fairness.
